Acceptance of Terms. By using Filmhound, you agree to these Terms of Use, and any additional terms and conditions that may apply to specific areas of the website or to particular transactions. If you do not agree to these terms, please do not use the Filmhound services.
Use of Service. Filmhound is a service that cuts, sleeves, and stores film. We reserve the right to refuse service to anyone for any reason at any time.
Ownership of Materials. The film that is stored at Filmhound belongs to the customer, and Filmhound is not responsible for any damage or loss of the film while it is being stored. We will take all reasonable precautions to ensure that the film is stored safely and securely.
Pricing and Payment. The pricing for our services is available on our website, and we reserve the right to change our pricing at any time. Payment is due at the time of service, and we accept credit card payments.
Cancellation Policy. Customers may cancel their service with Filmhound at any time. If a customer cancels their service before the completion of the work, they will be responsible for any work that has already been done.
Warranty and Disclaimer. Filmhound makes no warranties, expressed or implied, about the accuracy, reliability, completeness, or timeliness of the services. Filmhound does not warrant that the services will be uninterrupted or error-free.
Limitation of Liability. Filmhound shall not be liable for any damages whatsoever arising out of the use of or inability to use the services, including but not limited to direct, indirect, incidental, consequential, special, or punitive damages.
Indemnification. You agree to indemnify, defend, and hold harmless Filmhound, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms of Use or any activity related to your account.
Non-Refundable Deposits. All deposits made to a client's Filmhound account are final and non-refundable. By making a deposit, clients acknowledge and agree to this term.
Credit for Non-Archived Films. In cases where films, such as blank rolls, do not require archiving services, the corresponding value will be credited back to the client's Filmhound account. This credit can be used for future archiving services. Please note, these credits are not refundable as cash or through any other payment methods.
Social Media Use of Client Images. By using Filmhound services, you agree that unless you have explicitly opted out in your profile settings, Filmhound may use images of your archived films for our social media posts and marketing materials. This use is purely for promotional purposes and will not involve any compromise of your personal information or film content privacy. Filmhound is committed to respecting your choices regarding the use of your images; therefore, you can disable this feature at any time in your profile settings.
Termination. Filmhound may terminate or suspend your access to all or part of the services, without notice, for any reason or no reason, including without limitation breach of these Terms of Use.
Governing Law. These Terms of Use shall be governed by and construed in accordance with the laws of the state of Alabama, without giving effect to any principles of conflicts of law. Any legal action or proceeding relating to your access to, or use of, the services shall be instituted in a state or federal court in Alabama.
Changes to Terms of Use. Filmhound reserves the right to change these Terms of Use at any time. Your continued use of the services after any changes to these Terms of Use will signify your agreement to be bound by them.
